The exact complaint from class members is in regards to the July 2014 Bar Exam in which some test takers encountered a program glitch that prevented them from uploading their answers.  The ExamSoft class action settlement may offer cash payments to those who file timely claims.

Exam Soft Settlement Quick Notes

  • Includes all people who used the SofTest Software to take the July 2014 Bar Exam
  • The settlement amount has been capped at $2.1 million
  • Qualified class members will receive up to $90 in cash in the form of a check
  • If the settlement pool exceeds $2.1 million each eligible Class Member will receive a pro rata share based on the total number of approved claims submitted
  • Proof of purchase is not required as a list is already available
  • Class members will have 45 days to submit a claim form from 45 days after the date of entry of the Final Judgment
  • Exam Soft has hired attorneys Jay P. Lefkowitz, Joseph Serino Jr.,and Kristin Sheffield-Whitehead (from KIRLAND & ELLIS LLP)
  • People who took the bar exam in the states of New Jersey, Massachusetts, or the U.S. Virgin Islands are not allowed to file a claim for reasons unknown at this time
