WAG Settlement

Waste Away Group has reached a settlement in a class action lawsuit, which alleged that the company engaged in inappropriate contracting and pricing practices, most notably, the price increases, environmental and administrative charges, and fuel surcharges for the waste collection and recycling services, which the plaintiff claims were conducted in an improper manner and amounted to a breach of contract for its customers.

While Waste Away Group has denied any wrong doing in the matter, it has agreed to settle the lawsuit to avoid expenses of a trial. The settlement agreement has been examined by Lawrence County’s Circuit Court and been preliminary determined to be fair and reasonable. A final fairness hearing will be held by the court on 9th June 2015 to decide on the settlement.

Class members

Class members in the case are defined as anyone whom entered into a contract with Waste Away Group and received their services between 1st January 2006 and 31st December 2013. Please note that franchised and individual residential customers are not covered by the settlement.

What are the settlement benefits?

WAG has agreed to pay cash benefits to all eligible class members. The benefits will include:

1) Approximately $120 per service location for all members who were WAG customers for more than 6 years between the period of January 1st 2006 and December 31st 2013
2) Approximately $80 per service location to all members who were customers for at least 4 years but less than six years between the period of January 1st 2006 and December 31st 2013
3) Approximately $30 per service location to all members who were customers for less than 4 years between the period of January 1st 2006 and December 31st 2013.

Filing for claim

Class members are not required to file for a claim. All customers who meet the settlement requirements will automatically receive a check with their benefits. However, members can file a notice to be excluded from the settlement, at which point they will forego the benefits. Class members can also file a written objection to the court objecting to the terms of the settlement.
