Balance Shaft Settlement

• Obtain information about the lawsuit entitled “Majeed Seifi et al. v. Mercedes Benz USA LLC” which is case number 3:12-cv-05493 on the docket
• The Balance Shaft case will be pending out of the U.S. District Court for the Northern District of California
• Troy Masami Yoshino, Chad Allen Stegeman and Johnny J. Yeh will represent the defendant i.e. Mercedes
• Roy A. Katriel of the Katriel Law Firm and Gary S. Graifman of Kantrowitz Goldhamer & Graifman PC will represent all class members who do not opt of the settlement terms
• The lawsuit revolves around the balance shaft gear in the M272 engine or the idle gear that drives the timing chain in the M273 engine (this issue cause for the “check engine light” to remain illuminated, and the vehicle to misfire and/or stop driving)

Class members state that Mercedes knew of the problem but failed to provide the information to the general public before buying a pricey Mercedes automobile.  The lawsuit offers further evidence in the form that Mercedes technicians were taught how to diagnose the problem and replace the parts starting in 2007.

Quick facts associated with the Balance Shaft Settlement

• Around 300,000 autos are estimated to be part of this lawsuit
• Mercedes will pay attorneys’ fees of up to $2.475 million
• The exact settlement terms are not yet known but it is thought Mercedes will pay 100 percent, 70 percent, or 37.5 percent of the reasonable repair cost necessitated by the alleged defect
• Mercedes concludes no admittance of wrong doing in the case
• For repairs that were not done at a Mercedes dealership class members will receive $4,000 or the actual amount the fix cost (whichever is less)
